Terms and Conditions

 

Services and Goods:

The quotation provided sets out a description of services, hardware and software that PowerNET agrees to provide to you, for the amounts set out in the quotation.  The terms cover all hardware supplied by PowerNET including (but not limited to) notebooks, desktops, servers, computer parts and peripherials, networking equipment including routers and switches, printers and multifunction devices. 

 

Payment:

All prices are expressed exclusive of GST.  Payment for hardware and software is due on delivery or as per terms arranged with PowerNET.  Goods remain the property of PowerNET until paid in full.  If the order is cancelled before we deliver we reserve the right to charge a re-stocking fee of 20% of the total value quoted.  Some goods have a no returns policy from the supplier in which case a 100% restocking fee applies.

 

Warranty classifications:

Return to base warranty (RTB):The hardware or equipment needs to be physically returned to PowerNET or to the vendor.  Replacement of any parts will be covered by warranty.  The warranty does not cover:

  • Restoring equipment to original state unless completely covered by the vendor.
  • Restoring data.
  • Returning and installation of equipment back onsite.
  • Diagnostics other than those done over the phone with the vendor.
  • Data backups.
  • ** PowerNET standard terms of labour and travel apply to these exceptions

Repair at customer site (RCS):The equipment can be repaired over the phone with the vendor where practicable or by replacing a part that has been shipped.  Standard charges apply if PowerNET needs to interface with the vendor and take the necessary steps to install the part and/or bring the equipment back online.  If the equipment needs to be taken away standard RTB terms will apply.

Plug and play devices and parts (PPP):Equipment that needs no setup and has malfunctioned (example mouse, keyboard, USB stick) and is under warranty can be shipped to us or direct to the vendor.  Replacement will be shipped back to you (freight charges apply).  The customer will be responsible for ensuring that they can reconnect and use the replaced part in line with the vendor’s recommended practices.

Carry in warranty (CIW):The equipment will need to be returned to the vendor or PowerNET (as per agreement).  The hardware will be repaired or parts will be replaced.  All terms covered under RTB will apply to a carried in product. 

Onsite warranty (OW):Some equipment will be under a 9 x 5, 13 x 5 or 24 x 7 warranty term.  In the event of failure of a component the vendor may go onsite to repair/swap components or will ship a replacement part within the SLA / warranty terms.  Standard PowerNET charges will still apply for

  • Initial diagnostic to determine failure and subsequent follow up with the vendor.
  • Replacing part if applicable and restoring equipment back to it’s original condition unless covered by vendor warranty for onsite repair.

 

Exclusions

  • In most cases the warranty from most vendors will be null and void if:
  • The serial number has been removed or damaged.
  • Improper site preparation and maintenance.
  • Damage to equipment.
  • Modifications not approved by the vendor.
  • Operated outside the specified usage parameters.
  • Virus infections.
  • Software and interfacing parts not compatible with the original equipment.

 

Repairs and System Restores:

Data loss: PowerNET is not responsible for any loss of data or programs when a equipment is returned for warranty repairs.  The end user must ensure that all critical applications and data have been backed up and verified.  Proprietary and confidential information must be removed from the equipment before submitting it for repair.

Restoration of equipment to original condition: Most warranty terms only cover replacement of the failed part.  Vendors are not responsible for restoration of any programs or data other than the standard installed software. 

Vendor liability:  If any product or equipment fails the vendor has a maximum liability of lesser of the price of the product and cost of repair or replacement.  The vendor and PowerNET are not liable for any damages cause by the product failure including economic loss, business interruption and any consequential damages.

Client responsibility:  The client is expected to maintain a proper operating environment and maintain equipment as stipulated by the vendor manual.

 

Limitation of Liability:

We will not be held responsible for any problems, errors, faults or costs associated with:

1.        Software or hardware manufactured by third party vendors.

2.        Unauthorised use of your system by employees without our knowledge.

3.        Changes or modifications to your systems by someone other than us.

4.        Accident, neglect, misuse or abuse of the system.

5.        Damaged or disruption to your systems caused by factors beyond our control such as power failures, floods or other natural disasters.
